1. Limited Warranty
PORTE USA, warrants that its products are free from defects in material and workmanship (excluding installation) for one (1) year from the date of delivery to the original purchaser.
If a defect is verified, PORTE USA will, at its sole discretion, repair or replace the defective product or part. No refunds are issued once production begins, as all products are custom-made.
Warranty Limitations
- Warranty applies only to the original purchaser or original buyer of the structure in which the product was installed.
- The warranty is void if repair or replacement is performed by anyone other than PORTE USA without written approval.
- Installation-related damage is only covered if performed by PORTE USA.
- Natural wear, scuffing, color variations, or exposure-related aging are not considered defects.
- Glass components are covered by the glass manufacturer’s separate warranty.
This Limited Warranty sets forth PORTE USA maximum liability for its iron products. PORTE USA makes no other warranty, expressed or implied, including implied warranties of merchantability and fitness for a particular purpose, with respect to its products except as set forth above. No distributor, dealer or representative has the authority to change or modify this Limited Warranty. In no instance shall PORTE USA be responsible for indirect, consequential or incidental damages. Some states do not allow the exclusion or limitation of implied warranties or of incidental or consequential damages, so the limitation or exclusion may not apply to you. IN SUCH CASE, THE DURATION OF ANY IMPLIED WARRANTY SHALL BE THE SAME AS THAT OF THE EXPRESSED WARRANTY STATED HEREIN. PORTE USA NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PARTY TO ASSUME FOR IT, ANY OTHER
LIABILITY.
2. Exclusions
This warranty does not cover:
- Normal aging, fading, or wear of paint and finishes
- Scratches, scuffs from handling or use
- Variations in appearance due to hand-forged craftsmanship
- Improper installation, handling, storage, or maintenance
- Unauthorized repairs or modifications
- Glass breakage (glass is covered by its manufacturer)
- Exposure to high humidity, coastal air, acid rain, or harsh chemicals
- Shipping damage (must be claimed with carrier within 3 calendar days)
- Force majeure events such as fire, flood, war, or governmental actions
- Non-PORTE USA’s products or other brands; (i.e. pull-handles, or items added to the unit after the sale);
- Condensation on doors or windows or any related water damage, which may occur as a result of humidity within the property or changes in the interior/exterior temperatures or any other environmental moisture-related issues
- Peeling paint or any other damages caused by condensation or improper ventilation
- Water damage caused by spraying the door/window with a pressurized hose is not the
responsibility of PORTE USA and as such is not covered under this warranty.
3. Warranty Notice Provision & Claims
📌 Notice Provision
To preserve your rights under this warranty, the original purchaser must notify PORTE USA **in writing** within **30 days** of discovering any defect. Claims must include:
- Description of the problem
- Date of discovery
- Product identification
- Photographs of the issue
Failure to notify us within 30 days may void your warranty coverage.

A 30-day period must be provided to allow PORTE USA to inspect the product before resolution.
4. Estimate Terms
- Estimates are valid for **14 days** from the issue date, unless otherwise noted.
- All prices and lead times may be subject to change after this period.
- Modifications after estimate approval may result in **additional fees and production delays**.
- Proceeding with payment constitutes acceptance of:
- These terms
- Our Remodeling Services Agreement (if applicable)
- Our Warranty & Invoice Terms
- Our Contract Addendum (if applicable)
5. Invoice & Payment Terms
- Invoices are valid for **14 days** unless otherwise noted.
- All invoices are **due upon receipt** unless otherwise noted.
- A processing fee applies to all credit card payments.
- Invoices overdue by 30 days accrue **3% monthly interest**.
Production Begins Only After:
1. Final approval of shop drawings
2. Receipt of non-refundable deposit
Payment Responsibility:
- The person/company placing the order will be the person responsible for payment. Lack of payment of the homeowner/owner of property/company in charge of a commercial project to the builder, subcontractor, designer or any other representative that ordered the product is not a reason to refuse payment of said product, given that the products are made to order.
6. Terms & Conditions
🔹 Ownership & Risk of Loss
- Products ship **FOB Origin**. Risk of loss transfers to the customer upon delivery to the carrier.
- Title transfers upon shipment, and PORTE USA is not liable for in-transit damages.
🔹 Custom Product Policy
- All products are custom-fabricated and **non-refundable** once production begins.
- Slight variations in color, texture, or finish are natural and enhance the product’s handcrafted character.
🔹 Liability Limitation
PORTE USA is **not liable** for:
- Incidental, consequential, or indirect damages
- Labor or trim work associated with reinstallation
- Finish or material degradation caused by improper care or environment
🔹 Indemnification
The client agrees to indemnify and hold PORTE USA harmless from any claims, losses, or legal expenses arising from:
- Breach of these terms
- Misuse of PORTE USA products
- Infringement of third-party rights (e.g., design, privacy, trademarks)
This indemnification survives the conclusion of any agreement or transaction.
7. Legal Disclosures
- Unpaid balances may result in **mechanic’s liens** and may void all warranties.
- Even if the product hasn't been installed yet, specially fabricated materials like custom doors are protected under Tex. Prop. Code § 53.021(3) — as long as:
- "The materials were specially fabricated for use in the project even if they were not delivered to or incorporated into the property."
- Warranty coverage is suspended until full payment is received.
- Products installed within **2 miles of a coastline** must be specified and built for coastal use; otherwise, the warranty may be limited.
